The Employer's Role

The H1B visa application process is mainly driven by the employer. You cannot apply for an H1B visa independently. You need a U.S. employer willing to offer you a job in a specialized field. They must initiate the H1B visa petition for you. A job offer is mandatory.

Employer's Responsibilities

Once you secure a job offer, your employer takes charge of the application process. They must first file a Labor Condition Application (LCA) with the U.S. Department of Labor. The LCA indicates that your employer will pay you at least the prevailing wage for your position and ensures that hiring you doesn't negatively impact the local job market.

After the LCA approval, your employer will complete Form I-129, the "Petition for a Nonimmigrant Worker.” At this stage, you will provide your educational documents, resume, and letters of recommendation to support your employer's petition. Your employer continues to lead the process.

Cap Selection

Following the submission of the I-129 petition, your application enters the cap selection phase. The H1B program has an annual cap of 85,000 visas, with 20,000 reserved for applicants holding a U.S. master's degree or higher. If the number of petitions exceeds this cap, a random selection process, known as the lottery, is used. While luck plays a role, preparation is key.

Consular Processing

If your petition is selected in the lottery, you will move to consular processing. If you are outside the U.S., you must apply for the H1B visa at a U.S. Embassy or Consulate in your home country. You will attend an interview where you need to present proof of your job offer, qualifications, and ties to your home country.
